Terms and Conditions


Firearm Retailer & Gunsmith Terms and Conditions

1. Compliance With Federal, State, and Local Laws

All firearm sales conducted by Original Gunworks comply with all applicable federal, state, and local laws governing the sale, transfer, and possession of firearms and ammunition.

Purchasers must meet all legal requirements established by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and applicable state authorities, including completion of required documentation and background checks.

Failure to meet eligibility requirements will result in denial of transfer and may result in applicable restocking or administrative fees.

2. Eligibility to Purchase Firearms

By purchasing from Original Gunworks, the buyer certifies that they:

  • Are legally eligible to purchase and possess firearms under federal, state, and local law.
  • Are not prohibited from owning firearms due to criminal convictions, restraining orders, or other disqualifying conditions.
  • Are of legal age to purchase firearms or ammunition.
  • Will comply with all applicable firearm storage, transportation, and ownership laws.

Providing false information during a firearm purchase may constitute a federal criminal offense.

3. Background Checks

All firearm transfers require completion of ATF Form 4473 and submission to the National Instant Criminal Background Check System (NICS) or applicable state background check system.

Firearm transfers will not be completed until a “Proceed” response or legally mandated waiting period has been satisfied.

If a transaction is delayed or denied by NICS or a state authority, Original Gunworks is not responsible for the outcome and may charge administrative or restocking fees.

4. Firearm Transfers (FFL Transfers)

Firearms purchased online or through third parties must be shipped to a licensed Federal Firearms License (FFL) dealer for transfer.

Customers must complete the background check process and all required documentation before taking possession.

Transfer fees, storage fees, or additional background check fees may apply.

If a firearm is not picked up within 30 days, it may be subject to storage fees or returned to the sender.

5. Returns and Refunds

Due to the regulated nature of firearm sales:

  • All firearm sales are final once the transfer has been completed.
  • Firearms that have left the premises cannot be returned except for manufacturer warranty claims.
  • Firearms that have not yet been transferred may be subject to 10–20% restocking fees.

The following items are non-returnable:

  • ammunition
  • special order items
  • opened accessories or parts

Defective firearms must be addressed through the manufacturer’s warranty process unless otherwise stated.

6. Manufacturer Warranty

All firearms sold by Original Gunworks are subject to the manufacturer’s warranty policies.

Warranty service is typically handled directly through the manufacturer unless otherwise arranged by the shop.


Gunsmithing and Custom Work

7. Gunsmith Work Orders

All firearms left with Original Gunworks for repair, modification, or customization must be accompanied by a signed work order detailing:

  • The requested work
  • Estimated cost
  • Estimated completion time

Completion dates are estimates only and may vary due to parts availability or unforeseen technical issues.

8. Modification and Performance Disclaimer

Custom firearm work may alter the original configuration of a firearm.

The customer acknowledges that:

  • modifications may affect reliability, warranty coverage, or factory specifications
  • firearms modified for competition or performance may require specialized maintenance
  • Original Gunworks is not responsible for misuse, improper maintenance, or unauthorized modifications performed after service.

9. Firearms Left for Service or Storage

Firearms left at the shop longer than 90 days after service completion notification may incur storage fees.

Firearms abandoned for extended periods may be considered abandoned property and handled in accordance with applicable law.


NFA Items

10. NFA-Regulated Firearms and Accessories

Certain regulated items are controlled under the National Firearms Act (NFA), including suppressors, short-barreled rifles, and machine guns.

Purchases of NFA items require:

  • federal approval
  • submission of required tax forms
  • payment of applicable federal tax stamps

Transfer times are determined by the **Bureau of Alcohol, Tobacco, Firearms and Explosives and may take several months.

All NFA sales are final once paperwork has been submitted.


Consignment Sales

11. Firearm Consignment Policy

Customers may consign firearms with Original Gunworks for resale under the following conditions:

  • The consignor must legally own the firearm.
  • A consignment agreement must be signed.
  • The shop will determine a reasonable sale price in consultation with the owner.

Upon sale, the shop will retain a consignment commission (commonly 15–25%).

Unsold firearms may be retrieved by the owner subject to administrative fees.


Safe Handling and Liability

12. Firearm Safety Responsibility

Upon lawful transfer of a firearm, the purchaser assumes full responsibility for its:

  • safe handling
  • secure storage
  • lawful use
  • transportation

Safe storage devices and responsible firearm ownership practices are strongly recommended.

13. Limitation of Liability

To the fullest extent permitted by law, Original Gunworks shall not be liable for:

  • improper or unlawful use of firearms or ammunition
  • injuries, damages, or losses caused by negligent handling
  • modifications performed by third parties after service
  • criminal acts involving firearms sold or serviced

Ownership and responsibility transfer to the purchaser upon lawful completion of the transfer.

14. Compliance With Restricted Items

Certain firearm accessories or configurations may be restricted depending on jurisdiction.

Customers are responsible for ensuring that any purchased product is legal in their place of residence before ordering or taking possession.

Orders that violate applicable laws may be canceled.

15. Order Refusal or Cancellation

Original Gunworks reserves the right to refuse or cancel any order for reasons including but not limited to:

  • legal compliance concerns
  • suspected fraud
  • inventory errors
  • regulatory restrictions

Refunds will be issued according to the company’s refund policy.

16. Governing Law

These Terms and Conditions shall be governed by the laws of the state in which Original Gunworks operates.

17. Acceptance of Terms

By purchasing, transferring, consigning, or submitting a firearm for service with Original Gunworks, the customer acknowledges that they have read and agree to these Terms and Conditions.
